This entry considers natural law theories only as theories of law. That is not to say that legal theory can be adequately identified and pursued independently of moral and political theory. Nor is it to deny that there are worthwhile natural law theories much more concerned with foundational issues in ethics and political theory than with law or legal theory. Natural law theorists, on the other hand, did not conceive their theories in opposition to, or even as distinct from, legal positivism contra Soper at Natural law theory accepts that law can be considered and spoken of both as a sheer social fact of power and practice, and as a set of reasons for action that can be and often are sound as reasons and therefore normative for reasonable people addressed by them. But because legal theories conceived of by their authors as positivist are, by and large, dominant in the milieux of those likely to be reading this entry, it seems appropriate to refer to those theories along the way, in the hope of overcoming misunderstandings that while stimulating certain clarifications and improvements of natural law theorizing have generated some needless debate.

The Disintegration of Natural Law Theory

This article discusses the meta-ethical presuppositions necessary for understanding the ethical naturalism common to several contemporary natural law arguments. This analysis, while conscious of the historical antecedents in medieval Aristotelianism with special reference to Thomas Aquinas, concentrates on the contemporary thrust of natural law discussions. Natural law theory at its best has a realist foundation based on human persons; this moral theory has rationality articulated as a necessary condition and is thoroughly cognizant of the common good or the public interest. The article attempts to spell out the set of conditions necessary for natural law, and moral and legal theory, through an analysis of the writings of several contemporary analytical philosophers and the role these central metaphysical concepts play in the respective theories. In common with Fuller, Oakeshott, Hayek and Dworkin, Finnis argued for an internally sanctioned connection between law and morality, while also firmly rejecting the utilitarian justification of the modern legal order assumed by jurists belonging to the tradition of legal positivism. In contrast to these other theorists, however, Finnis did not examine the idea of natural law exclusively in terms of formal or procedural principles of legal justice. Instead, he insisted that the justification of the modern rule of law required the exposition of a substantive theory of human nature and the moral goods and values necessary to its perfection.

Natural Law and Natural Rights ; second edition is a book about natural law and natural rights by the philosopher John Finnis. The book was first published by Oxford University Press. Finnis discusses law , with reference to natural law and natural rights, and practical reason. He also proposes a list of basic human goods, including practical reflection, life, knowledge, play, aesthetic experience, sociability friendship , practical reasonableness, and religion. A second edition was published in The philosopher Stephen Buckle described Finnis's list of proposed basic goods as plausible. However, he considered Finnis's account of the basic requirements of practical reasonableness more controversial, arguing that Finnis's requirement of "respect for every basic value in every act" was intended both to rule out consequentialism in ethics.
